1. Terms and Conditions

  1. The Vodacom Showmax Data Deal Promo Terms and Conditions (“Promo Terms”) apply to the Vodacom Showmax Data Deal Promo that is offered to eligible Vodacom customers (Customers).
  2. These Promo Terms are supplementary to and must be read in conjunction with the Showmax Terms and Conditions – Global, and the Vodacom Subscription Rules for Promotional Offer (hereinafter collectively referred to as “Promotional Legal Terms”). The Promotional Legal Terms shall apply to the use of the Showmax Service for the duration of the Vodacom Showmax Data Deal. By indicating your acceptance in the “I Agree” field, you represent and warrant that you are 18 years of age or older and agree to abide by and be bound by the Promotional Legal Terms.
  3. Showmax Service” means the service offered by Showmax which is the trade name and trademark proprietary to MultiChoice Support Services (Proprietary) Limited (from now on referred to as “Showmax”), which may be accessed through an application or a website and, which allows the subscriber to access Live TV, Video On Demand (VOD) film, series and kids content on their Devices.
  4. Showmax Subscribers can stream or temporarily download television shows, movies, video or audio clips and other audio-visual materials (‘Content’) by using an electronic device which is capable of connecting to the Internet, including but not limited to computers, mobile phones, tablets, media players, smart TVs, decoders, set-top boxes, gaming consoles, media adaptors, and other similar devices, which devices comply with the technical requirements to access the Content as set out on the Showmax Website (‘Access Device’).
  5. In order for Showmax Subscribers to access and receive the Showmax Service using certain Access Devices, Showmax has developed or made available the Showmax software application (‘Showmax App’). Access Device, Showmax Device and Showmax App constitute a Showmax Platform.
  6. You can access and receive the Showmax Service through the showmax.com website and any other platforms that Showmax may make available for receiving the Showmax Service.

General Information

  1. Promo Terms are only applicable and valid in the Republic of South Africa (the Territory). The Vodacom Showmax Data Deal Promo comprises:
    1. Showmax Mobile subscription, bundled with 10GB of Showmax data (per month) supplied by Vodacom for R69 for the first 3 (three) months period of subscription (“Initial Subscription Period”); and,
    2. Showmax Mobile subscription, bundled with 3GB of Showmax data supplied by Vodacom for R69 per month, after the Initial Subscription Period in paragraph 2.1 (i) until the Vodacom Showmax Data Deal Promo is terminated.
  2. The abovementioned Vodacom Showmax Data Deal Promo does not have a free Showmax Service trial nor is stacking allowed.
  3. This Vodacom Showmax Data Deal Promo will commence at 00:00 hrs on 15 September 2022 (“Service Launch Date”) and it shall remain valid for a period of one year (“the Promo Period”) from the Service Launch Date.
  4. The data that is purchased together with the Showmax Subscription is valid for 30 days from the date that it is loaded, and it will expire at 23:59 pm of day 30 (thirty).
  5. There will not be a carry-over of the unused data value to the following month.
  6. If any of the following scenarios apply to you (the Customer), take note that if:
    1. during the Initial Subscription Period, you cancel your subscription to the Showmax Service, the unused data value will continue to run until it lapses at 23:59 pm of day 30 (thirty).
    2. you resubscribe to or reinstate the Showmax Service at any time during the Initial Subscription Period, while your data bundle is still valid, you will have access to the data bundle value that is remaining for the month in which you have resubscribed.
    3. you terminate your subscription to the Showmax Service during the Initial Subscription Period, you will forfeit your access to the 10GB Showmax data supplied by Vodacom that is bundled with the Showmax Service during the termination period.
    4. you resubscribe to the Showmax Service after the Initial Subscription Period has been completed, following the termination in 2.6.3 above, you will only be eligible to purchase or access the Showmax Mobile subscription, bundled with 3GB of Showmax data per month.
    5. If you upgrade your Showmax Service subscription to Showmax, Showmax Pro, and Showmax Pro Mobile, you will no longer access the Vodacom Showmax Data Deal Promo.
    6. during the Initial Subscription Period you decide to purchase the Showmax Mobile subscription (the current rate being R39) without the Vodacom data bundle, you will only have access to the Showmax Mobile without the data bundle.  
  7. When the Vodacom Showmax Data Deal Promo ends, you may purchase the Showmax Subscription without the data bundle at https://www.showmax.com and you can purchase Vodacom data bundle separately and directly from Vodacom.
  8. It will not be possible to share or transfer the Vodacom Showmax Data Deal once purchased.
  9. The Customer will be able to purchase the Vodacom Showmax Data Deal on www.showmax.com/vodacom   
  10. The Vodacom Showmax Data Deal can only be used for streaming and accessing videos on the Showmax app or website and cannot be used for browsing outside Showmax URLs.

3. Eligibility

  1. The promotion is exclusively available to Customers on the Vodacom network and it will only be accessible on smartphones or tablets.
  2. The applicable/relevant Vodacom data referred to in these Promo Terms will only be provided if the Customer pays using the Vodacom payment channels. In other words, Customers can only make payment via Vodacom’s Add to Bill or prepaid and top-up channels, provided that they have airtime.

4. Miscellaneous

  1. These Promo Terms, in so far as they relate to the Showmax data that Vodacom supplies, must be read in conjunction with the Vodacom Subscription Rules for Promotional Offer at https://www.vodacom.co.za/vodacom/terms/showmax-mobile
  2. Unless otherwise stated, the Showmax Terms and Conditions – Global shall remain in full force and effect. 
  3. In case of a discrepancy, the Promotional Legal Terms will prevail.
  4. Unless otherwise extended, this version of the Promo Terms will only apply during the Promo Period.
  5. Showmax reserves the right to, at any time and for any reason, terminate the Vodacom Showmax Data Deal.

5. Privacy

  1. Personal information
    1. “Personal Information” means personally identifiable information as prescribed in the Protection of Personal Information Act 4 of 2013 which includes but is not limited to name, address, phone number, identification number, and location data.
    2. We make reasonable efforts to ensure that the use of your personal information complies with the law and is legitimate, with our primary goal in mind, namely improving our services and your user experience on our https://stories.showmax.com/ (hereinafter referred to as the “Website”).
    3. Showmax will process your personal information only for the purposes of your subscription to the Showmax Service as more fully described in the Showmax Privacy Policy which you can find at https://stories.showmax.com/privacy-policy/. The Showmax Privacy Policy is updated from time to time and explains how we treat your personal information, who we share your information with, and measures taken to protect your privacy when you use our Service.
  2. Collection of information
    1. We are required by law to collect certain personal information and are legally obligated to deny you the Service if such information is not availed.
    2. Apart from the legal obligation mentioned above, we also need to collect your Personal Information for quality service delivery. Please note that although this is voluntary, without such information we may not be able to provide you with a quality service.
  3. Minors
    1. When registering a minor as a Vodacom subscriber, a person with parental authority shall open and maintain an account in their name for and on behalf of the minor. For purposes of these Promo Terms, a person with parental authority shall include the birth parents of a minor, a legal guardian or another person who can demonstrate legitimate authority over the minor’s affairs.
