Terms & Conditions

1.     Eligibility

1.1              Enter the competition by answering questions about your favourite show - Adulting - on stories.showmax.com/adulting-mettlestate-competition  

1.2              To stand a chance to win, all answers provided must be correct.

1.3              The competition will run from 13 December 2024 to 5 January 2025 (“Competition Period”).

1.4              The draw for the winner will take place on 8 January 2025, and the winner will be announced on 13 January 2025 at 20:00 Central African Time.

2.     The prize

2.1              One person with the correct answers to all the questions will be selected by random selection as the winner of the prize.

2.2              The prize includes attending the exclusive season premiere of Adulting S3 at Mettlestate with 3 (three) friends, and participating in a bespoke gaming challenge of EA FC (formerly known as FIFA) against the lead cast of Adulting - Thembenkosi, Luthando, Thabiso and Nhlanhla.

3.     Competition terms and conditions

3.1.            The winner must reside in Johannesburg (and proof of residency may be required) and must be 18 years or older.

3.2.            Showmax will not be responsible for any costs or expenses that you (and your friends) incur during and for purposes of your participation in the competition and your acceptance and/or use of the prize.

3.3.            By entering into and participating in the competition, and accepting the prize:

3.3.1.              you give consent to Showmax to use your name, video, image, voice, photograph and likeness for publicity purposes as part of Showmax’s promotional activities in advertising, marketing and/or promotional materials, including on social media platforms, including TikTok, Facebook, Twitter, Instagram and YouTube, for which no fee, royalty or other compensation will be payable;

3.3.2.              you confirm that you have read, understood and agree to be bound by these terms and conditions, as they may be amended from time to time;

3.3.3.              you agree to receive communication from Showmax and/or its affiliates or agents in connection with the competition; and

3.3.4.              you may not participate in or win a competition if you have won a competition promoted by Showmax within the previous 6 months. You will be eligible to participate in a competition promoted by us after the expiry of 6 months.

3.4.            It is your responsibility to ensure that your entry is received by us prior to the expiry of the Competition Period. Any entries that are not received by us prior to the closure of the competition will not be eligible to participate, regardless of the reason for the late entry. Without limitation, we and our affiliates are not responsible for any problems or technical malfunction of any telecommunications network or lines, online systems, servers or providers, computer hardware or software failure or malfunction, traffic congestion (whether on the Internet or other device or medium), or any combination thereof, or any other technical or other problems.

3.5.            We and our affiliates are not responsible for any injury or damage to your or any other person’s computer, mobile telephone or other device used by you to enter or obtain any materials related to the competition.

3.6.            It is your responsibility to ensure that any personal information you provide to us for purposes of the competition is accurate, complete and up to date.

3.7.            We do not make any representations or give any warranties, whether expressly or implicitly, as to a prize, and in particular, but without limitation, make no representations and give no warranty that:

3.7.1.              your entry or participation in the competition will necessarily result in you winning a prize;

3.7.2.              a prize, or any aspect thereof, will meet your requirements, preferences, standards or expectations; or

3.7.3.              a prize, or any aspect thereof, will be satisfactory, free from defects, safe or reliable.

3.8.            Prizes are not transferable and may not be deferred, changed or exchanged for cash or any other item. Showmax reserves the right to replace the prize, or any aspect thereof, with an alternative prize of equal or higher value if circumstances beyond Showmax make it necessary to do so.

3.9.            We and our affiliates will not be responsible for any harm, damage, loss or claim relating to the provision of any element of a prize or any changes to a prize that may be made at any time.

3.10.         You may not win a prize if it is unlawful for us to supply such a prize to you. If you do win such a prize, you will forfeit it.

3.11.         The winner will be announced on Showmax’s official social media channels including, without limitation, TikTok, Twitter, Instagram and Facebook on 13 January 2025. If we are, or a third-party supplier is, unable to contact a winner within 2 (two) business days or if the winner is unable to claim the prize within 2 (two) business days, the winner will forfeit the prize and Showmax reserves the right to draw a new winner under the same conditions.

3.12.         We may invite you (and your friends) to participate in any of our marketing activities, to appear in person in any electronic and/or the print media, and/or to endorse, promote or advertise of our services, for which no fee, royalty or other compensation will be payable. You may decline such an invitation.

3.13.         We may require you to provide us with such additional information and documentation as we may reasonably require to process, confirm and facilitate your acceptance and/or use of a prize. If you refuse to provide us with the requested information or documentation, you will forfeit the prize.

3.14.         If you win a prize provided by a third-party supplier, the supplier may contact you to arrange the collection thereof. In this regard, you must collect the prize at the time and date arranged with the supplier of the prize. All correspondence regarding the prize must be directed at the supplier of the prize and Showmax will not be responsible for any further correspondence, harm, damage, loss or claim relating to the provision of any element of the prize.

3.15.         We and our third-party suppliers reserve the right to vary, postpone, suspend or cancel the competition and any prizes, or any aspect thereof, without notice, at any time, for any reason which we deem necessary. In the event of such variation, postponement, suspension or cancellation, you agree to waive any rights, interests and expectations that you may have in terms of this competition and acknowledge that you will have no recourse against us, our affiliates and/or third-party suppliers.

3.16.         You agree that your participation in the competition, and your acceptance and/or use of a prize, or any aspect thereof, is at your own risk.

3.17.         We and our affiliates will not be responsible and disclaim all liability for any loss, liability, injury, expense or damage (whether direct, indirect, incidental, punitive or consequential) of any nature, whether arising from negligence or any other cause, which is suffered by your participation in the competition or the acceptance and/or use by you or any third party, of any prize, or by any action taken by us or any of our affiliates in accordance with these terms and conditions. If any liability is imputed to us, such liability will be limited to the value of the prize.

3.18.         You, and in the event of your death, your family, dependents, heirs, assignees or any other beneficiaries of your estate, indemnify and hold us and our affiliates harmless against any claim by you (whether direct, indirect, incidental, punitive or consequential) of any nature, whether arising from negligence or any other cause, relating to any injury, loss, liability, expense and/or damage which you may suffer, howsoever arising, in relation to your entry into this competition and/or acceptance and/or use by you of a prize. The provisions of this clause 3.18 applies mutatis mutandis to your friends.

3.19.         You acknowledge that the acceptance and use of a prize is subject to the provision that:

3.19.1.           these terms and conditions apply to you;

3.19.2.           you indemnify and hold us and our affiliates harmless against any claim by you or any third party if you suffer any loss or damage pursuant to your acceptance and/or use of a prize.

3.20.         If you fail to comply with any of these terms and conditions, then without prejudice to any other remedy which we may have:

3.20.1.           you will be automatically disqualified, and you will forfeit the prize if you have already won it;

3.20.2.           you will pay us for any loss or damage incurred by us directly or indirectly as a result of your non-compliance, including all our legal costs (including attorney and own client costs) which we may incur in taking any steps pursuant to your non-compliance;

3.20.3.           you indemnify and hold us and our affiliates harmless against any claim by any person (whether direct, indirect, incidental, punitive or consequential) of any nature, whether arising from negligence or any other cause, relating to any death, injury, loss and/or damage which may be suffered howsoever arising in relation to your failure to comply therewith.

3.21.         For purposes hereof, “affiliate” means our partners, co-promoters and sponsors of this competition, our holding companies, our subsidiaries and their respective holding companies and subsidiaries, and our and their directors, officers, employees, agents and representatives.

3.22.         These terms and conditions will be construed, interpreted and enforced in accordance with the laws of the Republic of South Africa.

3.23.         Showmax’s decision on any matter concerning the competition and/or arising out of these terms and conditions is final and binding on you, and no correspondence will be entered into.
